IPTT TERMS & CONDITIONS
I. USAGE (all users)
1. You must be at least 13 years old to use iPTT. We recommend that minors 13 years of age or older ask their legal guardian for permission to use iPTT.
2. You agree not to use this service directly or indirectly to conduct activity reasonably deemed to be illegal under US law.
3. You are solely responsible for the content of your communication and conversations using iPTT.
4. You agree to release Circle Apps LLC, its employees and agents from any responsibility directly or indirectly related to your use of iPTT.
5. You agree to use iPTT in a manner that is reasonably deemed to be responsible and safe.
6. You agree to refrain from engaging in any form of unlawful “hate speech”.
7. You agree not to use iPTT to transmit, share or otherwise make available any content that is manifestly abusive and/or can reasonably be deemed threatening, inflammatory, fraudulent, invasive or otherwise legally objectionable.
8. You agree not to spam users on any channel via Whisper or Public modes (see Subscriber Terms below for qualification of this point in Subscription Channels).
9. In cases where safety/security is concerned we reserve our right to monitor and record conversations and other data related to user accounts to ensure compliance without notice.
10. Inappropriate usernames will be rejected, changed, or deleted as deemed fit under our sole discretion.
11. You agree to respect and comply by all relevant intellectual property laws, including copyright laws.
12. We reserve our right to suspend, cancel or delete any user account and/or user access to iPTT in the event abuse is deemed to be taking place and/or as deemed fit under our sole discretion.
13. We reserve our right to suspend the Admin status of any user on any channel (free or paid) at our sole discretion.
14. We reserve our right to reassign usernames and/or accounts (free or paid) at our sole discretion.
15. While we stand behind the quality of our service/apps, we do not warrant or guarantee a specific level of service.
16. We may periodically run planned or unplanned maintenance updates and system upgrades during which time service may be limited and/or interrupted.
17. These Terms & Conditions, including Usage, Subscriber Terms, and Privacy Policy are subject to change without notice.
II. SUBSCRIBER TERMS (rented channels only)
The following Subscriber Terms apply to users subscribed to an iPTT channel and are an integral part of these Terms & Conditions:
1. Your subscription to an iPTT channel(s) is in no way a sale or an agreement to sell you channel(s) or any ongoing rights whatsoever related to any channel(s) on iPTT.
2. While we strive to process your requests within a few hours, please allow up to 48 hours to process requests.
3. Channel names are subject to approval and must be submitted via the form in Channel Settings.
4. All payments are final, and there are no refunds.
5. We reserve the right to terminate your subscription if, in our view, we have reason to believe you're in violation of these Terms and Conditions. The decision whether to issue a refund and the extent of such refund is entirely left to the sole discretion of Circle Apps LLC. In other words, we may issue a pro-rated refund, a full refund or none at our sole discretion.
6. If your channel is an "in-kind" exchange with iPTT for something you offered, you are subject to the Subscriber Terms with the exception that no refund can ever be claimed regardless of reason for termination of the channel.
7. While the Terms & Conditions above prohibit the use of spam of any form on iPTT, promoting or advertising - within reason - on a channel that you are subscribed to is not considered spam. This applies to the channel subscriber and the other perm admins on that channel (subscriber’s approval of their status is assumed).
8. While we stand behind the quality of our service/apps and continue to improve it, we do not warrant or guarantee a specific level of service or bug-free experience and shall not make any refunds due to service-level complaints.
